TERMS OF SERVICE
01 — SERVICE DESCRIPTION
CarTrust provides vehicle history and valuation reports based on data sourced exclusively from third-party providers. Reports are compiled for informational purposes only and are intended to assist buyers in making informed vehicle purchase decisions. The accuracy, completeness, and availability of report data are determined entirely by the respective third-party data providers.
02 — REPORT ACCURACY
CarTrust aggregates data from third-party databases and presents it as-is. Reports reflect the data available from these providers at the time of generation. CarTrust does not independently verify, guarantee, or assume responsibility for the accuracy or completeness of third-party records. Any discrepancies or omissions in report data are at the sole discretion and responsibility of the originating third-party data providers. We strongly recommend using reports alongside a professional physical vehicle inspection.
03 — PAYMENTS
All payments are processed via Safaricom M-Pesa STK push. Payment processing, confirmation, and settlement are handled entirely by Safaricom and are subject to Safaricom's terms and conditions. Reports are delivered instantly upon payment confirmation.
- +If no data is found for your vehicle, you will not be charged
- +Payment disputes are subject to resolution by Safaricom at their discretion
04 — REFUND POLICY
Refund eligibility is assessed on a case-by-case basis and is subject to the discretion of the relevant third-party service providers involved in the transaction.
- +Refund requests must be submitted within 7 days of purchase by contacting support@cartrust.co.ke
- +Duplicate purchases for the same VIN within 30 days are eligible for refund consideration
- +Refunds for incomplete or inaccurate data are subject to the third-party data provider's policies and discretion
- +Approved refunds are processed via M-Pesa reversal and may take up to 14 business days, subject to Safaricom's processing timelines
- +Reports that have been accessed, downloaded, or shared are generally not eligible for refund
- +CarTrust reserves the right to decline refund requests that do not meet the above criteria
05 — USER RESPONSIBILITIES
By using CarTrust, you agree to:
- +Provide accurate VIN / chassis numbers for searches
- +Use reports only for lawful purposes (personal due diligence, vehicle purchasing)
- +Keep your account credentials secure and not share them with others
- +Not redistribute, resell, or commercially exploit report content without written permission
06 — INTELLECTUAL PROPERTY
All content, design, and report formats on CarTrust are our intellectual property. You may share your purchased report with prospective buyers of the specific vehicle, but may not reproduce the report format or branding for commercial use.
07 — LIMITATION OF LIABILITY
CarTrust acts solely as an intermediary that aggregates and presents data from third-party providers. To the fullest extent permitted by law:
- +CarTrust assumes no liability for the accuracy, completeness, or reliability of information sourced from third-party data providers
- +Any claims regarding data quality or content are at the sole discretion and responsibility of the originating third-party provider
- +CarTrust is not liable for any decisions made, losses incurred, or damages arising from the use of report information
- +Payment processing matters, including disputes and reversals, are handled at the discretion of Safaricom and relevant financial institutions
- +Reports are advisory in nature and should supplement, not replace, professional vehicle inspections
08 — GOVERNING LAW
These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya.
