Affiliate Program Terms & Conditions

1. Overview

These Affiliate Program Terms & Conditions ("Terms") govern your participation in the CarTrust Affiliate Program ("Program") operated by Kisokolab Limited ("CarTrust", "we", "us"). By registering as an affiliate, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

To join the Program you must:

• Be at least 18 years of age.
• Provide accurate registration information including your country, a valid mobile number and email address. Affiliates may be based in any country.
• Not be an employee, contractor, or immediate family member of a CarTrust employee.
• Not have previously had an affiliate account terminated for cause.

3. Referral Links & Tracking

When you register we issue you a referral code and link; they start earning once your application is approved. A purchase is attributed to you when a customer opens your link and completes a paid report purchase within 30 days, on the same device and browser (a cookie records the referral), or when the customer enters your code at checkout. If the customer clears their cookies or uses another device and doesn't enter your code, we can't attribute the purchase to you.

4. Commission Structure

You earn a share of CarTrust's profit on each qualifying report purchase made through your referral link or code. Profit means the amount the customer paid, excluding VAT, less CarTrust's cost of producing that report; we don't disclose that cost, and your dashboard shows what each referral earned. Your share depends on the purchase's place among your qualifying referred purchases in that calendar month:

These tiers and shares may change with 14 days' notice. The amount paid is after the referral discount the customer receives. A sale that makes no profit earns no commission.

Commissions are not earned on purchases made with your own affiliate email address or before your application is approved. If a referred purchase is refunded, its commission is deducted from your balance automatically, and the purchase no longer counts towards your monthly tier. We may also withhold commission on purchases we reasonably believe are fraudulent.

5. Payments

Commission is added to your balance when a referred payment is confirmed. You can request a payout from your dashboard once your available balance is at least KES 500. Our team reviews each request and pays it via the method you chose when you applied; you can follow its status in your dashboard. Affiliates in Kenya are paid in Kenyan shillings (M-Pesa or bank transfer). Affiliates in any other country are paid in US dollars (bank transfer, PayPal or Wise): commission is earned in KES and converted at the exchange rate on the day you request the payout, and that amount is what we pay. CarTrust may hold a payout while it verifies the referrals behind it.

Commissions are paid gross, without any tax withheld by CarTrust. You are solely responsible for determining and paying any income tax or other tax obligations that apply to you in your jurisdiction as a result of commissions earned under the Program.

6. Promotional Rules

You may promote CarTrust through your own website, social media, email (to opt-in lists), and word of mouth. You must not:

• Bid on CarTrust branded keywords in paid search (Google Ads, etc.).
• Use misleading, false, or deceptive promotional materials.
• Place your referral link in unsolicited email (spam) or pop-up/pop-under ads.
• Offer cash-back or undisclosed incentives to purchasers without prior written consent.
• Misrepresent the features, pricing, or availability of CarTrust reports.

7. Intellectual Property

CarTrust grants you a limited, non-exclusive, revocable licence to use our approved logos, badges, and marketing materials solely for the purpose of promoting the Program. You must not alter, modify, or create derivative works from CarTrust brand assets without written permission.

8. Compliance with Law

You are responsible for complying with all applicable laws in your jurisdiction, including disclosure requirements for affiliate relationships (e.g., the FTC Endorsement Guides in the US, CAP Code in the UK, or equivalent local regulations). You must clearly disclose your affiliate relationship whenever you promote CarTrust.

9. Termination

Either party may terminate participation in the Program at any time with written notice. CarTrust may immediately suspend or terminate your participation if we determine (at our sole discretion) that you have violated these Terms, engaged in fraudulent activity, or brought CarTrust into disrepute. Upon termination, you can request a payout of any commission earned on qualifying referrals before the termination date, minus any amounts owed to CarTrust.

10. Disclaimers & Limitation of Liability

The Program is provided "as is". CarTrust makes no warranty that the referral tracking system will be uninterrupted or error-free. To the maximum extent permitted by law, CarTrust's total liability to you under these Terms shall not exceed the commissions paid to you in the three months preceding the claim.

11. Changes to These Terms

We may update these Terms at any time. Changes will be communicated via email and posted at this URL. Your continued participation after the effective date of any change constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
